In a litigated divorce, a judge's job is to hear the evidence and decide the facts of the case. This usually boils down to the equitable distribution of assets and income, interpreting any prenuptial agreement, calculating alimony and child support, and approving a parenting plan. And while divorces are loaded with emotional triggers, the judge doesn't deal with any of them.
In this video taken from a longer conversation, Amy Goodblatt and I discuss the idea of the elephant in the room, that big emotional something in a divorce that keeps couples and families from being able to come to a resolution and how the Collaborative Divorce Process is designed to support people through it. We also cover how a Collaborative Divorce Team can allow for creativity in asset distribution, including finding agreeable tax-advantaged ways to help families make better agreements than they would in court.
